1. Introduction

Welcome to RAFINYA. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and RAFINYA SASU (“RAFINYA,” “we,” “us,” or “our”), a company registered in Morocco.

By accessing our AI companion interface, website, or using our booking services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Scope of Services

RAFINYA provides a two-sided marketplace and digital travel assistant service that includes:

• AI Travel Companion: An artificial intelligence interface that converses with users to understand tastes, interests, and budgets to generate travel recommendations.

• Marketplace & Booking: Connecting users with “Vetted Suppliers” (third-party local guides, agencies, hotels, and experience providers) across Africa.

• Payment Facilitation: Providing secure booking and payment links to finalize reservations.

3. User Obligations

By using our services, you represent and warrant that you are at least 18 years of age. You agree to:

• Accuracy: Provide accurate, current, and complete information during your conversation with the AI and during the booking process (including passport details and health requirements).

• Lawful Use: Use the services only for lawful purposes and in accordance with these Terms.

• System Integrity: Not interfere with, compromise, or disrupt the integrity of the AI, the website, or the data contained therein (including attempting to inject malicious prompts into the AI).

• Account Security: Maintain the confidentiality of your login credentials or booking links.

4. AI Disclaimer & Accuracy

RAFINYA utilizes advanced Artificial Intelligence to provide travel suggestions. By using this service, you acknowledge that:

• Recommendation Only: The AI acts as a digital companion. Its suggestions are based on data analysis and your inputs but do not constitute guaranteed professional advice.

• Verification: While we strive for accuracy, AI systems can occasionally generate incorrect information (“hallucinations”). You verify critical details (such as visa requirements, vaccinations, or specific flight times) before travel.

• Evolution: The AI learns from interactions. Your conversation data is used to improve the quality of recommendations (as detailed in our Privacy Policy).

5. Bookings, Payments, and Billing

• Pricing: All fees are clearly defined in the specific service agreement or checkout link provided to you. Prices for travel services are subject to change until the booking is confirmed with payment.

• Secure Payments: We send secure, third-party payment links (e.g., via Stripe or local banking partners). Payment is due upon receipt unless otherwise agreed.

• Non-Payment: RAFINYA reserves the right to suspend services or cancel unconfirmed bookings if payment is not received by the specified deadline.

6. Cancellations and Refunds

• Supplier Policies: As an aggregator of various local experiences, cancellation policies may vary depending on the specific Vetted Supplier you book with. The specific cancellation terms for your trip will be provided to you alongside your booking link.

• Default Policy: Unless stated otherwise in your booking confirmation, our standard administrative fee is non-refundable once the booking is confirmed.

7. Intellectual Property

The services, including the AI algorithm, branding, logo, original content, text, displays, and the design thereof, are owned by RAFINYA SASU, its licensors, or other providers and are protected by Moroccan and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Limitation of Liability

To the fullest extent permitted by law:

• Intermediary Status: RAFINYA is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Vetted Supplier, nor for any personal injuries, death, property damage, or other damages or expenses resulting there from.

• Service Interruptions: We do not guarantee that the AI service will be uninterrupted or error-free.

• Damages: In no event shall RAFINYA, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from your use of the service.

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the services will immediately cease.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any dispute arising out of or regarding these Terms shall be subject to the exclusive jurisdiction of the competent courts in Marrakesh.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the service after such changes constitutes acceptance of the new Terms.
